This Privacy Policy (the "Policy") sets out the practices of Sync with respect to the collection, use and disclosure of personal information, including your personal information, and applies to the situations set out in Section 2 regarding the use of Sync products and services, including the Sync.com website. For ease of reference, we refer to ourselves as "Sync" or simply "we".
For the purposes of this Policy, personal information is any information that allows a natural person to be identified, directly or indirectly or that relates to an identified or identifiable natural person or household.
This Policy applies primarily to your contact and profile information. Save for certain strict exceptions described further below, Sync does not access or process the files, content or documents you store on or share via our cloud services (the “File Data”).

2. How do we use and disclose your personal information?
How we process your personal information will depend on your use of Sync products and services. Below is a description of how Sync collects, uses and discloses your personal information with the understanding that we may also process your personal information as required by applicable law or otherwise with your consent.
In the course of our activities, we process your personal information in the manner set out in sections 2.1 to 2.5:
- To create and manage your user account;
- To provide you with the products or services you subscribed to in a secure manner;
- To process your payment;
- To communicate with you and respond to your inquiries;
- To improve our products and services or develop new ones;
When you browse our website, we refer you to section 5 of this Policy and to our Cookie banner. The use of cookies may involve the processing of your personal information.

3. Communication of your personal information
Sync will not disclose your personal information to any third parties without your consent, except as permitted by law or under the following limited circumstances:
- To service providers, as is reasonably required to fulfill the purposes set out above, provided such service providers shall be contractually bound to appropriate privacy requirements;
- To comply with a legal process such as a law, regulation, search warrant, subpoena, court order or law enforcement request. When providing information in response to a legal inquiry or order, we will verify its validity and disclose only the information that is legally required. Sync will make reasonable efforts, within the bounds of the law, to notify you should your personal information be subject to disclosure.
- To resolve a contractual dispute regarding your use of any Sync product or service;
- To resolve issues related to the use of your account for illegal activities;
- In connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction; or
- As permitted under applicable law.
4. Minors under 14 years of age
You must be 13 years of age or older to register and use the Services. You certify that You are 18 years old or, if You are between the ages of 13 and 18, that You are using the Service with the supervision of Your parent or legal guardian who agrees to be bound by these Terms. If you are a parent or guardian and you are aware that your children have provided us with personal information without your consent, please contact us. If we discover that we have collected personal information from someone under the age of 13 without the consent of the parent or guardian, we will take steps to delete that information from our systems.
5. What cookies do we use?
Sync uses cookies that collect information to provide and improve our products and services as well as to target advertising to you. A cookie is a small data file that is stored on your device. We may use "persistent cookies" to save your registration ID and login password for future logins to our service. We may use "session cookies" to enable certain features of our service, to better understand how you interact with our service and to monitor aggregate usage and web traffic routing on our service. You can change your browser options to stop accepting cookies or to prompt for your permission before accepting cookies. Choosing to decline cookies may affect your access to our products and services.
The Sync Website may include links to third-party Web sites. These third-party Web sites may assign different cookies to you. Those cookies may be used to track your involvement with the advertising site. You may choose not to accept these cookies. Sync does not control these parties, and you should review their privacy policies to learn more about what, why and how they collect and use personal information.

6. Where do we store personal information?
Account information we collect are stored in our own systems in Canada and with third-party service providers in the United States to deliver the service.
Information that may be contained within the file data you store with Sync while using the service will be stored in either Canada or the United States, depending on your data region.
7. Security measures and protection of your personal information
We deploy appropriate security measures to protect your personal information. In particular, we have put in place appropriate physical, technical and administrative safeguards to ensure the protection of your information.
In addition, we have implemented access control measures to limit access to your personal information to only those of our employees who require access in the course of their duties.
The content of the files you store through our service is encrypted in accordance with the applicable provisions of our Terms of Service, as well as the privacy settings and preferences you select in the Privacy Center. Sync uses commercially reasonable efforts to maintain encryption; however, we cannot guarantee that encryption will remain effective at all times.
While Sync implements appropriate security measures, IT IS YOUR RESPONSIBILITY TO SAFEGUARD YOUR ACCOUNT AND YOUR PASSWORD.
If you have reason to believe that personal information has been compromised, please contact our Privacy Officer at the coordinates listed in section 1 of this Policy.
8. Privacy Center and Encryption
Our Privacy Center gives you control over the features that may involve the processing of your files, file metadata, previews, thumbnails, or shared links. These controls are designed to help you understand and manage how your content is processed when you choose to use specific features.
Some features may be enabled by default to support usability, compatibility, performance, and access to files across different devices, browsers, and file types. You may change these settings at any time in the Privacy Center. If you turn off a feature, Sync will stop performing the processing associated with that feature, and the feature will no longer be available, except where processing is necessary to provide the core service, comply with applicable law, protect the security and integrity of our Services, prevent abuse, or enforce our terms.

Sync may access certain metadata relating to your account and use of the Services, such as storage information, in order to calculate your storage usage, available storage space, and applicable storage limits. Sync’s core storage service is end-to-end encrypted by default. However, some optional features may require specific files or selected content to be temporarily processed using a different encryption level in order for those features to function. This does not mean that Sync has access to your File Data generally. Rather, only the specific file, content, metadata, preview, thumbnail, shared link, or other information required for the feature you choose to use may be temporarily accessible to, or processed by, Sync or our service providers on your behalf.

9. What are your rights regarding your personal information?
By law, you may have various rights with respect to your personal information, subject to certain exceptions. In particular, you may have the following rights:
9.1 Access to your personal information
You may ask us whether we hold any personal information about you and, if so, you may request access to that personal information.
9.2 Rectification
You may ask us to correct any incomplete or inaccurate personal information we hold about you.
9.3 Withdrawal of consent
In some cases, you may withdraw your consent to the disclosure or use of the personal information we hold about you. You understand, however, that in such a case, we may no longer be able to process your personal information in the ways set out in sections 2.1 to 2.5.

11. File a complaint about our handling of your personal information
Sync takes complaints and comments about our handling of your personal information very seriously. We invite you to contact our Privacy Officer if you have any complaints or comments about our confidentiality practices.
Your complaint will be reviewed by the Privacy Officer, who will determine whether the processing of your personal information complies with our confidentiality program and any applicable laws.
If you reside in Canada, you may also file a complaint with the Office of the Privacy Commissioner of Canada (“OPC”) using the form available on the OPC’s website or with the regulatory authority of your province of residence. However, we invite you to first contact our Privacy Officer to give us a chance to address your concern.
12. External sites or services
This Policy does not apply to third-party websites, pages or applications that may be accessed through our website. If you follow such links, these third-party sites or services may have their own privacy policies that you should review before submitting your personal information.
13. How do we update this Policy?
To ensure the clarity and transparency of our Privacy Policy, it may be amended from time to time. Changes will be posted on the Sync website, along with the date of the last update. Changes will be effective as of the date of the last update.
